Revision of NSF Award Terms and Conditions

Dear Colleagues:

NSF recently revised  the suite of Award Terms and Conditions listed below in their message.   These revisions will apply to all new awards and funding amendments to existing awards made on or after January 28, 2019.   Also included for your information are summaries of some of the significant changes and clarifications.  Please review these revisions in more detail and forward to your faculty and researchers as appropriate.

·NSF Agency Specific Requirements to the Research Terms and Conditions (ASR);

oGrantee Responsibilities and Federal Requirements, Article 12. This article has been revised for consistency with the Uniform Guidance. The grantee is required to obtain NSF prior written approval for any project change specified in the Research Terms and Conditions Appendix A Prior Approval Matrix.

oOverall Document. Throughout the document, websites and references have been updated for consistency with the Proposal and Award Policies and Procedures Guide and to reflect current information.

oFormat, Content and Timing of Technical Reporting, Article 8. This article has been updated to include language stating that the submission of the Final Project Report and Project Outcomes Report for the General Public (POR) indicates that the research on the project is completed.

·Cooperative Agreement Financial & Administrative Terms and Conditions (CA-FATC);

oProject Changes, Article 8. This article has been revised for consistency with the Uniform Guidance. The awardee is required to obtain NSF prior written approval for any project change (such as subawarding or transferring part of an NSF award after an award has been made) specified in Article 3, Prior Approval Requirements.

oFee Payments, Article 48. This new term and condition addresses when payment of fee is allowable for NSF awards.

oOverall Document. Throughout the document, websites and references have been updated for consistency with the Proposal and Award Policies and Procedures Guide and to reflect current information.

oPrior Approval Requirements, Article 3. Specific examples of coverage that is addressed in the prior approval matrices has been removed from CA-FATC.

oEquipment, Article 6. References to types of organizations and title to equipment has been clarified to reflect applicability of the provisions.

oProject Reporting Requirements, Article 15. This article has been updated to include language stating that the submission of the Final Project Report and Project Outcomes Report for the General Public (POR) indicates that the research on the project is completed.

·Cooperative Agreement Modifications and Supplemental Financial and Administrative Terms and Conditions for Major Multi-User Research Facility Projects and FederallyFunded Research and Development Centers;

oProject Changes, Article 8. This article has been revised for consistency with the Uniform Guidance. ·Special Terms and Conditions (FL 26) for Administration of NSF Conference or Travel Grants

oHarassment-Free Environment, Article 4. This new term and condition implements NSF’s requirement that grantees establish and disseminate a policy or code-of-conduct that addresses sexual harassment, other forms of harassment, and sexual assault for grants which support NSF-sponsored conferences.

oOverall Document. Throughout the document, websites and references have been updated for consistency with the Proposal and Award Policies and Procedures Guide and to reflect current information.

Each set of terms and conditions is accompanied by a summary of changes made to that document.

The revised Terms and Conditions will apply to all new NSF awards and funding amendments to existing NSF awards made on or after January 28, 2019.
